§ 1 Scope & Service
(1) EveryWayz operates an online platform (hereinafter the "Platform") for mediating mobile services (e.g. hairdresser, nail design, cosmetics) and mediates contracts for such services between customers and service providers.
(2) The contract for the service (hereinafter the "Service Contract") is concluded exclusively between the customer and the respective service provider. EveryWayz does not become a party to this Service Contract and does not provide the booked services itself.
(3) EveryWayz owes the customer the provision of platform functions for searching, booking, communication, and payment processing, as well as the forwarding of declarations within the scope of the mediation.
(4) Statutory rights of the customer against the service provider (e.g. due to defects/damages from the service) remain unaffected.
(5) The information provided by EveryWayz on the platform constitutes a non-binding invitation (invitatio ad offerendum) to submit a booking request. A mediation contract between EveryWayz and the customer as well as a Service Contract between the customer and the service provider only come into existence upon booking confirmation by EveryWayz.
§ 2 Contract Language and Storage of Contract Text, Booking Confirmation
(1) The language available for concluding the contract is exclusively German.
(2) The contract text is not permanently made available for retrieval in a customer account by EveryWayz after the contract is concluded. The current version of these General Terms and Conditions is available at any time at www.everywayz.de. Before submitting the booking or registration, the contract data can be printed out or electronically saved using the browser's print function.
(3) Upon conclusion of the contract, EveryWayz sends the customer the booking confirmation, including the legally required information for distance selling contracts, and the GTC once again by email.
§ 3 Registration & Identity Verification
(1) Users (customers) can and service providers must create an account. Service providers commit to participating in the AI ID check before activation to prove their identity and certificates. EveryWayz checks the submitted evidence only for plausibility and completeness and does not conduct any professional quality or suitability test of the service. The use of the platform is only permitted to unrestricted legally competent natural persons who have completed their 18th year of age.
(2) The customer is obliged to provide truthful and complete information during registration and to update any changes to their data immediately in their user account.
(3) There is no claim to activation or use of the platform. EveryWayz can reject the registration or access to the platform without giving reasons if there are factual reasons (e.g. incomplete or doubtful evidence, suspicion of security or fraud).
§ 4 Commission & Fees
For the successful mediation of a service via the platform, EveryWayz charges the service provider a service commission of 10% of the total price to be paid by the customer (gross booking price including any travel costs and surcharges). The customer incurs no additional fees from using the platform. According to § 19 UStG (small business regulation), no VAT is charged and reported on this commission. The service commission becomes due upon booking and is automatically retained by the payment service provider selected in each case (Stripe or PayPal); reference is made to § 5 of these General Terms and Conditions.
§ 5 Payment Processing & Payout
(1) Payment is processed via the payment service provider PayPal or by classic bank transfer. EveryWayz is entitled to accept payments from the customer on behalf of the service provider; the payment to EveryWayz (processed via PayPal or bank transfer) has a debt-discharging effect for the customer.
(2) The respective payment service provider (Stripe or PayPal) holds the amount paid by the customer in trust for the service provider. For all completed orders of the previous month, the payout to the service provider is made collectively on a monthly basis via the service provider's Stripe account, PayPal account, or bank account, usually by the 10th working day of the following month. The service provider is solely responsible for creating and sending a proper invoice to the customer in compliance with the requirements of § 14 UStG, as well as for the remittance of any applicable taxes (e.g. VAT). The service provider assures that they fulfill the necessary trade law requirements for the offered services. EveryWayz only issues the service provider an invoice for the retained mediation commission.
(3) EveryWayz reserves the right to invoice the customer for the costs of a failed payment if the payment fails due to circumstances for which the customer is responsible (e.g. incorrect or expired payment data, insufficient funds).
§ 6 Location & Obligations of the Customer (Mobile Service)
(1) Service Provision at Location: Since mobile services are involved, the service is provided at the location chosen by the customer. The customer must ensure that the provider is granted timely and unhindered access to the agreed location.
(2) If the service provider is not granted access to the location at the agreed time, they can demand an appropriate cancellation fee, unless this is based on a circumstance for which the service provider is responsible. The cancellation fee is based on the cancellation scale defined in § 7 of these General Terms and Conditions, which applies accordingly. The customer is allowed to prove that the service provider has suffered no damage or significantly less damage. The service provider retains the right to prove higher damages. Saved expenses and a reallocation of the appointment are taken into account.
(3) No-Show of Provider and Confirmation Code Rule: After an appointment has taken place, a confirmation code must be entered into the system. If, after the service time has expired, no code has been entered by either party, EveryWayz waits a period of 24 to 48 hours for the code to be submitted. If, within this period, neither the customer nor the service provider provides feedback or enters a code, EveryWayz's support team decides at its reasonable discretion on the release of the funds or the refund. Should the provider fail to appear without excuse, the customer is entitled to a full refund by EveryWayz. EveryWayz arranges the refund on behalf of the service provider via the platform. The no-show should preferably be reported to EveryWayz immediately. The assertion of legal claims remains unaffected.
(4) Responsibility for Location: The customer must take reasonable measures to ensure secure access and a low-risk environment (e.g., clear access routes, indicating special hazards). Damages suffered by the service provider at the location as a result of a breach of this obligation by the customer must be compensated by the customer.
(5) Limitation of Liability of EveryWayz: EveryWayz is liable without restriction for intent and gross negligence as well as for injury to life, body or health. In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations - i.e., those obligations whose fulfillment enables the proper execution of the contract in the first place and on whose compliance the contractual partner may regularly rely), EveryWayz's liability is limited to the typical, foreseeable damage. These limitations also apply in favor of the legal representatives and vicarious agents of EveryWayz if claims are made directly against them. Apart from that, liability is excluded. Liability according to the Product Liability Act remains unaffected.
§ 7 Cancellation and Rescheduling Conditions for Customers
(1) Customers can cancel confirmed bookings under the following conditions:
a) Free Cancellation: Cancellation is free of charge up to 48 hours before the agreed start of the appointment.
b) Cancellation Fees for Short-Term Cancellations: In the event of cancellation or a no-show within 48 hours before the start of the appointment, the service provider is entitled to a cancellation fee depending on the time of cancellation as follows:
- Cancellation between 48 and 24 hours before the appointment: 25% of the booking price;
- Cancellation between 24 and 12 hours before the appointment: 50% of the booking price;
- Cancellation less than 12 hours before the appointment or no-show: 75% of the booking price.
(2) In all cases, the customer is expressly allowed to prove that the service provider has suffered no damage or significantly less damage. The service provider retains the right to prove that higher damage has occurred. If the service provider can reassign the appointment (in whole or in part) or saves expenses, this will be correspondingly considered in the cancellation fee.
(3) Exempt from these cancellation fees are cancellations of appointments mediated by EveryWayz less than 48 hours before the start of the appointment; in these cases, free cancellation is possible within 2 hours of booking confirmation.
(4) Flexible Rescheduling: The customer has the right to independently reschedule an already confirmed appointment. However, this is subject to the following conditions:
- Rescheduling is only possible within a period of 14 to a maximum of 30 days from the original appointment date.
- An appointment can be rescheduled a maximum of ONCE per booking.
- Rescheduling is only permitted if a free slot exists in the service provider's digital calendar for the new desired appointment.
§ 8 Statutory Warranty Rights
(1) For the mediation services of EveryWayz, a statutory warranty right exists.
(2) We expressly point out that for the booked services themselves (the main service), the customer's statutory warranty rights exist directly against the respective service provider. EveryWayz is not obliged to perform and fulfill the Service Contracts and - without prejudice to the liability regulation in § 6 of these General Terms and Conditions - is not liable for breaches of duty by the service providers.
§ 9 Right of Withdrawal for Customers
(1) Customers who are consumers (§ 13 BGB) can withdraw from the mediation contract with EveryWayz and the Service Contract with the service provider in accordance with the statutory provisions.
(2) The complete withdrawal instructions, including the model withdrawal form, can be found directly after these GTC. The withdrawal information applies to both contract types. For the withdrawal of the Service Contract, EveryWayz accepts the withdrawal declaration and any associated refunds on behalf of the service provider.
(3) If both contracts are to be withdrawn, a single declaration to EveryWayz is sufficient. Details and the model withdrawal form can be found in the withdrawal policy, which is a component of these GTC.
§ 10 Reviews
(1) Customers can review service providers after they have provided the respective service. Reviews must be based on demonstrable facts, must be factual, and must not contain any offensive, defamatory, criminally relevant or otherwise illegal content. Offensive or untrue content will be deleted upon EveryWayz becoming aware of it.
(2) By submitting the review, the customer grants EveryWayz the free, territorially and temporally unlimited rights to use their review text. EveryWayz is entitled to publish the review on the platform and to use it for platform-related purposes.
(3) Unjustified multiple reviews, self-reviews or the attempt to manipulate the review system in a distorted manner are prohibited and can lead to the suspension of the customer account.
§ 11 Availability of the Platform
(1) EveryWayz guarantees network availability of the platform within its technical and operational capabilities. Excluded from this are:
- planned maintenance work, which EveryWayz informs about in advance where possible;
- outages based on technical or other problems outside EveryWayz's control (e.g. force majeure, third-party network outages, cyber-attacks), which EveryWayz could not prevent even when taking standard market care into account.
(2) The customer has no claim to an uninterrupted availability of the platform at all times; claims regarding the outages mentioned in the aforementioned exceptions are excluded.
§ 12 Contract Term, Termination and Amendment of GTC
(1) Customers and service providers can delete their account with EveryWayz at any time without giving reasons in text form (an email to business@everywayz.de is sufficient) or via the account settings. Already bindingly booked services and the associated payment obligations remain unaffected by the account deletion.
(2) EveryWayz may change these GTC, as far as this is necessary to implement
(i) changes in the law,
(ii) jurisdiction,
(iii) further technical developments or
(iv) security requirements
and the change does not unreasonably disadvantage the user.
We will inform about changes at the latest 4 weeks before they take effect in text form.
The user can object until they take effect. If they object, the user agreement can be terminated by both sides with effect to the time the change takes effect. We will point out the right of objection and termination separately in the notification.
Changes concerning main performance obligations or charges are only made with the express consent of the user.
§ 13 Place of Performance, Jurisdiction, and Severability Clause
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies to the extent that it does not deprive them of the protection granted by mandatory provisions of the law of the state where the consumer holds their habitual residence.
(2) The place of performance for all services arising from business relations with us is our registered office, provided that the user is not a consumer but a merchant, legal entity under public law or special fund under public law.
(3) For disputes with consumers (§ 13 BGB), the court at the consumer's place of residence holds jurisdiction according to § 29c ZPO; this court has exclusive jurisdiction for lawsuits against the consumer. For disputes with entrepreneurs, who are also merchants within the meaning of the HGB, the exclusive jurisdiction is agreed to be EveryWayz's registered office (§ 38 ZPO).
(4) Should individual provisions of this contract remain or become fully or partially invalid, this will not affect the validity of the remaining provisions. The statutory regulations apply in place of the invalid provision.

General Terms and Conditions for Service Providers (B2B)
§ 1 Scope and Subject of the Contract
(1) These General Terms and Conditions (hereinafter "Service Provider GTC") apply to all contracts and legal relationships between Asya Dik-Fesci, acting under EveryWayz (hereinafter "EveryWayz"), and the service providers registered on the platform (hereinafter "Service Providers"). Deviating, conflicting, or supplementary General Terms and Conditions of the Service Provider shall not become part of the contract unless EveryWayz expressly agrees to their validity in writing.
(2) EveryWayz operates an online platform for mediating mobile services. EveryWayz does not offer any services itself, but acts exclusively as an intermediary between the Service Provider and the end customer.
(3) These GTC are aimed exclusively at entrepreneurs within the meaning of § 14 BGB (German Civil Code). Consumers are excluded from registering as Service Providers.
§ 2 Contract Language and Storage of Contract Text

§ 3 Registration, AI ID Check, and Activation
(1) A prerequisite for using the platform as a Service Provider is registration. The registration process mandatorily requires the Service Provider to first create a regular customer account on the platform. After logging in, the application form provided for this purpose in the top right of the homepage must be completed in full. The Service Provider is obliged to provide all data required during registration truthfully and completely.
(2) After the profile has been activated by the EveryWayz team, the Service Provider must successfully participate in an AI-supported identification process (AI ID check). This involves proving identity (e.g., identity card) as well as any necessary professional qualifications and certificates.
(3) There is no legal entitlement to activation or use of the platform. EveryWayz may refuse activation if there are legitimate reasons, e.g., incomplete/doubtful proofs, suspicion of security issues/fraud, or violations of these GTC.
§ 4 Legal Relationship and Independence (No Bogus Self-Employment)
(1) The Service Provider acts as an independent entrepreneur. No employment, permanent staff, partnership, or franchise relationship is created between EveryWayz and the Service Provider.
(2) The Service Provider is free in accepting orders, structuring their working hours, and executing their activities and is not bound by instructions from EveryWayz.
(3) The contract for the actual service is concluded exclusively between the Service Provider and the customer. EveryWayz does not become a contracting party here.
§ 5 Obligations of the Service Provider and Provision of Services
(1) The Service Provider commits to fulfilling accepted bookings punctually, professionally, and in the promised quality at the agreed location.
(2) The Service Provider guarantees that they possess all official permits, business registrations, and qualifications necessary to perform their activities.
(3) Invoicing and Taxes: The Service Provider is solely responsible for issuing a proper invoice to the customer after providing the service (including showing VAT, unless the small business regulation applies). The remittance of all applicable taxes is the sole responsibility of the Service Provider.
(4) The Service Provider must ensure adequate commercial liability insurance that covers personal injury and property damage at the location. At the request of EveryWayz, the Service Provider must immediately provide proof of such insurance. If proof is missing, EveryWayz is entitled to refuse profile activation or temporarily suspend the profile until proof is provided.
(5) Calculation of Travel Time: As this is a mobile service offering, the Service Provider is obliged to independently calculate their travel time. The required travel time must mandatorily be included by the Service Provider in the offered time slots and calendar slots to prevent scheduling overlaps and delays for the end customer.
§ 6 Remuneration, Commission, and Payment Processing
(1) For the successful mediation via the platform, EveryWayz charges a service commission of 10% of the gross booking price (including any travel costs or surcharges).
(2) Payment processing is handled via the external payment service provider Stripe, the payment service provider PayPal, or by bank transfer. The Service Provider is obliged to store their Stripe Connect account, their PayPal account, or their bank details in their profile during registration and to link them to EveryWayz.
(3) The 10% commission is automatically retained by the respective payment service provider upon payment via the platform. EveryWayz will issue a proper invoice to the Service Provider for this retained commission once a month. Due to the application of the small business regulation (§ 19 UStG), no VAT is shown on the commission.
(4) The payout of the balance due to the Service Provider (booking price minus 10% commission) is collected and made once a month, usually by the 10th working day of the following month, to the Service Provider's registered Stripe, PayPal, or bank account.
§ 7 Cancellations, Rescheduling, and No-Shows
(1) Cancellation Fees for Cancellation by the Customer: If an already confirmed service is cancelled by the customer, the Service Provider receives the complete amount as compensation (100% of the gross booking price minus the platform's mediation commission) to offset the blocked time period.
(2) Rule for Customer Rescheduling: The Service Provider accepts that customers have the right to reschedule appointments once. However, this only applies if the rescheduling takes place within a period of 14 to 30 days and the Service Provider has a correspondingly free slot in their calendar.
(3) If the Service Provider cancels an already confirmed appointment intentionally or for their own reasons, they must communicate this as quickly as possible via the platform.
(4) No-Show & Confirmation Code Rule: If the Service Provider does not show up for an appointment unexcused, the customer will be fully refunded. If, after the service has been completed, no confirmation code is entered by the parties, the system freezes the payout. EveryWayz waits a period of 24 to 48 hours for the code. If neither party provides notice or enters the code within this time, EveryWayz's support team makes the final decision on the disposition of the funds. EveryWayz reserves the right to proceed according to the following graduated procedure in the event of repeated unexcused no-shows or short-notice cancellations:
- Level 1 (Warning): For the first unexcused no-show or more than two short-notice unexcused cancellations within three months, EveryWayz will issue a written warning.
- Level 2 (Temporary Suspension): In case of repeated violation after a warning has already been issued, EveryWayz may temporarily suspend the Service Provider's profile for up to 30 days.
- Level 3 (Permanent Deactivation): In the event of further violations after a temporary suspension, EveryWayz is entitled to permanently deactivate the profile and terminate the contract extraordinarily.
The right to immediate suspension and extraordinary termination without preceding levels remains unaffected in particularly serious individual cases (e.g., intentional no-show causing significant damage to the customer, criminal acts at the location, attempted fraud).
§ 8 Reviews
Customers have the option to review the Service Provider's services on the platform. The Service Provider hereby agrees to this. EveryWayz is not obligated to verify reviews for their accuracy, but will delete demonstrably untrue, insulting, or illegal reviews upon becoming aware of them.
§ 9 Liability and Indemnification
(1) EveryWayz is liable to the Service Provider only for intent and gross negligence. In the case of a breach of essential contractual obligations (cardinal obligations), EveryWayz is also liable for slight negligence, but limited to the foreseeable damage typical for the contract. These limitations of liability also apply in favor of EveryWayz's legal representatives and vicarious agents.
Liability for damages arising from injury to life, limb, or health as well as claims under the Product Liability Act remain unaffected by the aforementioned limitations of liability. Otherwise, liability is excluded.
(2) The Service Provider is exclusively responsible for defects, property damage, or personal injury that occur during the provision of the service at the customer's location.
(3) Indemnification: The Service Provider indemnifies EveryWayz as well as its legal representatives, employees, and vicarious agents against all third-party claims arising from a breach of duty for which the Service Provider is responsible, unless EveryWayz (co-)caused the damage. The Service Provider is obliged to inform EveryWayz immediately about asserted claims. EveryWayz is entitled to participate in the legal defense and to involve its own legal counsel at the Service Provider's expense.
§ 10 Contract Term, Termination, and Suspension
(1) The user agreement is concluded for an indefinite period of time.
(2) Both parties may terminate the contract at any time without giving reasons by deleting the account or by written notice. Services that have already been bindingly booked and not yet executed are not affected by the termination and must still be processed in accordance with the contract.
(3) The right to extraordinary termination for good cause remains unaffected. Good cause for EveryWayz exists in particular if:
- the Service Provider processes payments circumventing the platform (so-called off-platform bookings);
- the Service Provider provided false or misleading information during registration or in the ongoing contractual relationship, in particular regarding qualifications, business registration, or insurance coverage;
- a criminal investigation has been initiated against the Service Provider for an act connected with the activity offered on the platform;
- the Service Provider continues to culpably breach their obligations after going through the graduated procedure according to § 7 (4).
§ 11 Final Provisions, Place of Performance, and Jurisdiction
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) The place of performance for all mutual services under this contract is the registered office of EveryWayz.
(3) The exclusive place of jurisdiction for all disputes arising from this contract is the registered office of EveryWayz, provided the Service Provider is a merchant within the meaning of the German Commercial Code (HGB) (§ 38 (1) ZPO). If the Service Provider is an entrepreneur within the meaning of § 14 BGB, but not a merchant within the meaning of the HGB, the statutory place of jurisdiction for performance according to § 29 ZPO applies.
(4) If individual provisions of these GTC are or become invalid, the validity of the remaining provisions remains unaffected. The statutory provisions shall apply in place of the invalid provision.
Cancellation Policy
Cancellation
Customers who are consumers (§ 13 BGB) can cancel the usage/brokerage contract with EveryWayz and the service contract with the service provider in accordance with statutory provisions. The following cancellation policy applies to both types of contracts. To cancel the service contract, EveryWayz receives the cancellation explanation and associated customer payments on behalf of the service provider. If both contracts are to be canceled, a single statement to EveryWayz is sufficient.
Right of Cancellation
You have the right to cancel this contract within fourteen days without giving reasons.
The cancellation period is fourteen days from the day the contract is concluded.
To exercise your right of cancellation, you must inform us (EveryWayz, Asya Dik-Fesci, An der Helling 16, 55252 Mainz-Kastel, Germany, Phone: 0170 6436737, E-Mail: business@everywayz.de) by means of a clear statement (e.g. a letter sent by post or an e-mail) about your decision to cancel this contract. You can use the attached model cancellation form, but this is not mandatory.
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.
Effects of Cancellation
If you cancel this contract, we must reimburse all payments we have received from you, no later than fourteen days from the day on which we received your notice of cancellation from this contract. We will use the same means of payment for this refund that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this refund.
If you have requested that the services begin during the cancellation period, you must pay us a reasonable amount corresponding to the proportion of the services already provided by the time you notify us of the exercise of the cancellation right in respect of this contract compared to the total volume of services provided for in the contract. This applies to EveryWayz's brokerage service and the service provider's service respectively.
Attention: Expiry of the Right of Cancellation
The right of cancellation expires if the service by the service provider and the brokerage service by EveryWayz have been fully provided and you previously expressly agreed that the execution of the respective service will commence before the end of the 14-day cancellation period, and you simultaneously confirmed your acknowledgment that you will lose your right of cancellation once the service has been fully performed.

1) General Information

4) Hosting & Server Log Files
Hosting Provider: STRATO AG, Otto-Ostrowski-Straße 7, 10249 Berlin, Germany.
We have concluded a Data Processing Agreement (DPA) with STRATO.
When visiting the website, we process technically necessary data (so-called server log files), e.g.:

Status codes, transferred data volumes
Purpose: Stable operation, error analysis, defense against attacks (IT security).
Legal basis: Art. 6 Para. 1 lit. f GDPR.
Storage duration: Log files are generally only stored as long as necessary for the stated purposes and subsequently deleted/anonymized (unless security-relevant retention is required in individual cases).

For security reasons, this website uses SSL/TLS encryption (https). We also implement appropriate technical and organizational measures to protect data against loss, manipulation, and unauthorized access.
6) Contacting Us (E-Mail/Phone)
If you contact us (via e-mail, phone or using the contact form on www.everywayz.de), we process the data you provide to us.
Which data do we process?
Mandatory form details: Name, e-mail address, and message
Optional: further details you volunteer (e.g. phone number, additional contact details)
Technical metadata that may arise upon submission (e.g. time, possibly IP address for abuse prevention)
Purposes: Processing and answering your inquiry, follow-ups (e.g. by phone), documentation of communication, as well as abuse/spam prevention.
Legal basis: Art. 6 Para. 1 lit. b GDPR (when related to (pre-)contractual measures) or Art. 6 Para. 1 lit. f GDPR (general inquiries/efficient communication, abuse prevention).
Storage duration: We generally only store contact inquiries as long as necessary for processing. Beyond that, we only store contents if there are legal obligations or if necessary for the assertion/defense of legal claims.
7) Registration, User Account & Bookings
a) Registration/User Account
Data: First and last name, e-mail address, password (hashed/encrypted), phone number and address data if applicable.
Purpose/Legal basis: Account management, platform use, bookings (Art. 6 Para. 1 lit. b GDPR).
b) Self-Deletion by Users
You can delete your user account yourself.
What happens upon deletion? We deactivate/delete your account and remove or anonymize content as far as possible and legally permissible.
Important: Data that we must retain for legal reasons (e.g. billing/tax-relevant documents) will not be deleted immediately, but only after the expiration of statutory retention periods. Booking/transaction data may be preserved to the extent necessary for verification and abuse prevention (Art. 6 Para. 1 lit. c and/or lit. f GDPR).
8) Payment Processing via Stripe and PayPal (Payments & Payouts)
a) Payment Processing via Stripe
Service provider: Stripe Payments Europe, Ltd. (Ireland) ("Stripe").
Description: We use Stripe for payment processing and - if relevant - for payouts to providers. We do not store full payment data (e.g. full card/account numbers) on our servers.
Processed data (typical): Name, e-mail, billing data, transaction data (amount, currency, status), payout data for providers.
Purposes: Payment processing, refunds, payouts, fraud prevention.
Legal bases: Art. 6 Para. 1 lit. b GDPR; additionally Art. 6 Para. 1 lit. f GDPR.
Third country transfer (USA) - Note: Depending on the constellation, data may be processed within the Stripe group outside the EU/EEA. Appropriate safeguards (e.g. adequacy decision/standard contractual clauses) are taken into consideration. A residual risk may remain (e.g. authority access in the third country).
b) Payment Processing via PayPal
Service provider: PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal").
Description: We use PayPal to process customer payments as well as for the fiduciary custody and monthly payout of earned balances to our providers (marketplace payment processing). If you choose PayPal as a payment method or link your PayPal account as a provider, your payment and account data will be transmitted to PayPal. EveryWayz itself does not store complete bank or credit card data on its own servers.
Processed data: Name, e-mail address, PayPal account ID, billing address, transaction data (amount, date, currency, status), as well as payout and bank data of the providers.
Purposes: Execution of payments, processing of automated commission shares (platform fees), refunds, payouts to partners, identity matching as well as fraud prevention and platform security.
Legal bases: Art. 6 Para. 1 lit. b GDPR (contract execution and pre-contractual measures); additionally Art. 6 Para. 1 lit. f GDPR (legitimate interest in secure and smooth payment processing).
Third country transfer (USA) - Note: PayPal reserves the right to transfer data for fraud prevention and creditworthiness checks to partners and group companies outside the EU/EEA (in particular to the USA). PayPal uses recognized safeguards such as the EU-US Data Privacy Framework or standard contractual clauses for this purpose. Further information can be found in the PayPal privacy policy at www.paypal.com.
9) Identity Verification of Providers (Stripe Identity / KYC)
Providers may be required to clear an identity/address check before activation or before payouts. The background includes regulatory requirements (KYC) and risk minimization in marketplace operation.
Service provider: Stripe (including "Stripe Identity" and KYC processes within Stripe/Connect). For identity verification, we collect the necessary information and transmit it to our payment service provider Stripe. In some cases, additional documents (e.g. ID copies or proof of address) may be requested.
Processed data (depending on requirement):
Identity data (e.g. name, date of birth)
ID documents (e.g. passport/ID card/driver's license)
Proof of address if applicable
Selfie/image data if applicable (if required in the specific process)
Result/status data of the verification
Purposes: Abuse/fraud prevention, secure payouts, platform integrity, compliance with KYC requirements.
Legal bases: Art. 6 Para. 1 lit. b GDPR (contract execution/onboarding) and Art. 6 Para. 1 lit. f GDPR (security/fraud prevention interest).
Automated decisions (Art. 22 GDPR): If a verification is (partially) automated and this can have significant effects on you (e.g. non-activation), you can request human intervention, express your point of view, and contest the decision. Contact: business@everywayz.de.
Special risk: ID documents are particularly sensitive. Please exclusively use the designated platform process for this and refrain from sending ID documents via unencrypted e-mail.
10) Reviews (without public name display)
Reviews are displayed on the platform without your name being made publicly visible (anonymous/pseudonymized in the frontend). Internally, linking for abuse prevention and booking mapping may still be necessary (Art. 6 Para. 1 lit. f GDPR).
11) Cookies and "Tracking"
We use cookies that are necessary for the operation of the website (e.g. for security or session functions).
We do not currently use analysis/marketing tools (e.g. Google Analytics, Meta Pixel).
We would only use optional cookies/tracking after your consent (Art. 6 Para. 1 lit. a GDPR).

We only share personal data when necessary, e.g. to:

We only store data as long as necessary for the purposes. Beyond that, we store data to the extent that statutory retention obligations exist (especially commercial and tax law retention).
14) Reporting Obligations under the Platform Tax Transparency Act (PStTG)
As the operator of a digital platform, EveryWayz is obligated under the Platform Tax Transparency Act (PStTG) to report certain data about service providers active on the platform annually to the Federal Central Tax Office. The data subject to reporting include in particular: First and last name, date and place of birth, tax identification number, address, remunerations achieved in the reporting period as well as bank details (IBAN).
Legal basis: Art. 6 Para. 1 lit. c GDPR (legal obligation under § 13 PStTG). Recipient: Federal Central Tax Office (BZSt). Storage duration: 10 years after transmission (§ 14 PStTG).
